(a) It shall be illegal to operate the engine/jake brake on vehicles having a gross vehicle weight of 50,000 lbs. and greater while operating on the public roadways within the corporate limits of the City of Summersville, West Virginia, except for U.S. Route 19, for any purpose except emergency situations involving public safety that requires the use of the engine brake.
(b) Violation of this section will result in fines of $100.00 for a first offense, and $250.00 for additional offenses.
