For the purposes of this article, “Public Nuisance” means an act, condition or thing that is illegal because it interferes with the rights of the general public, per West Virginia Code §8-12-5 Sections (13), (23) and (44) as defined as follows:
(a) Section (13) means to prevent injury or annoyance to the public or individuals from anything dangerous, offensive or unwholesome;
(b) Section (23) means to provide for the elimination of hazards to public health and safety and to abate or cause to be abated anything dangerous, offensive or unwholesome;
(c) Section (44) means to protect and promote the public morals, safety, health, welfare and good order.
