(a) The accumulation of rubbish and garbage outdoors in or out of unprotected containers will attract animals, birds and insects, and be scattered by animals, birds, wind and traffic, which results in a littering and nuisance violations.
(b) Any person who places, deposits, dumps, or throws or cause to be placed, deposited, dumped or thrown any litter, as defined by this article, in or upon any public or private property, highway, road, street, alley, or upon other property without consent of the owner for such purpose by the governing body having charge thereof, shall be deemed guilty of a misdemeanor, and upon conviction, shall be fined not less than fifty ($50.00) dollars nor more than five hundred ($500.00) dollars and may be required, in discretion of the court, to pick up and remove from any public highway, road, street, alley, or public park, or public property as designated by the court, any and all litter placed, deposited, dumped or thrown contrary to the provisions of this section by anyone prior to the date of such conviction.
