527.07 EXCEPTIONS AND SPECIAL WAIVERS.
   (a)    Exceptions. The following uses of an activity shall be exempt from noise level regulations:
      (1)    Noise of safety signals and warning devices.
      (2)    Noise resulting from authorized vehicles, when responding to an emergency.
      (3)    Noise resulting from the provisions of municipal services.
      (4)    Any noise resulting from activities of a temporary duration permitted by law and/or for which a waiver has been granted by the City.
      (5)    The unamplified human voice (except as specified in Section 527.04(j).
      (6)    Parades and public gatherings for which a special waiver has been issued.
      (7)    Bells, chimes, carillons while being used for religious purposes or in conjunction with religious services, or for national celebrations or public holidays, and those bells chimes, carillons that are presently installed, and in use, for any purpose.
   (b)   Exemptions For Time to Comply. Upon good cause shown by the owner or responsible party for any noise source, the City shall have the power to grant an exemption from the requirement of this article in order to allow sufficient time for installation of needed control equipment, facilities or modifications to achieve compliance, not to exceed ten (10) days, provided that such exemption may be renewed as necessary, but only if satisfactory progress toward compliance is shown. A request for exemption shall be filed in writing with the City Recorder.
   (c)    Use Exemptions. The following uses and activities shall be exempt from noise regulations:
      (1)    Lawn maintenance equipment when it is functional within the manufacturer's specifications and with all mufflers and noise reducing equipment in use and in properly operating condition between the hours of 8:00 a.m. and 9:00 p.m.
      (2)    Nonamplified crowd noise resulting from activities such as those planned by day care centers, schools, and governmental or community groups.
      (3)    Amplified announcements, electronically amplified announcements at athletic events from 8:00 a.m. to 12:00 p.m.
      (4)    Construction and power tool noise used for construction, home maintenance, or home projects between the hours of 8:00 a.m. and 9:00 p.m.
   (d)    Special Waivers for Events, Social Gatherings and Parties.
      (1)    The City shall have the authority, consistent with this article, to grant special waivers, provided, the special events, social gatherings and parties requested to be held are conducted with respect to this article and others affected by sound. Noise created by such events shall be held to reasonable sound levels and not continued past unreasonable hours at night.
      (2)    Any person, group or organization may request a special waiver for such gatherings by writing the City, a letter of request including the following information:
         A.   The date, time and the place of the event, gathering or party.
         B.   A description of the special event, social gathering or party requested to be held.
         C.   A description of loud sound activities which may be generated by those in attendance.
         D.   The number of persons expected to attend the event, gathering or party.
         E.   Indicate the time the event, gathering, or party is expected to end.
         F.   Names of those persons in responsible charge of the event, gathering or party.
         G.   Provide contact information for the property owner and responsible person in charge.
         H.   Indicate if you have checked with adjoining property owners regarding your function.
      (3)    After a review by the City, you shall be notified within ten (10) days, as to approval or denial of your request to hold an event, gathering or party. If granted, additional comments or conditions may apply to holding your function.
