139.28 MEDICAL LEAVE OF ABSENCE.
   Employees who suffer illness and/or injury that become unable to perform usual occupational duties for periods exceeding accrued leave, may become eligible for medical leave without pay or benefits if they are not eligible for the Family and/or Medical Leave Act. Such leave shall not exceed ninety (90) days.
   Upon returning to work the employee may be placed back in his or her former position. However, if that position is not available then he or she shall be placed in a similar job, if one is available. If a similar job is not available, then he or she shall be placed in any job at any pay. If no job is available, then he or she shall be placed on a recall list for a period not to exceed ninety (90) days.
   COS reserves the right to refer employees for medical examination and/or evaluation at the City's expense if the relative extent of disability is questionable in the view of COS.
   In the event of occupational illness or injury the provisions of this policy do not apply. Administrative Regulations of the West Virginia Worker's Compensation Fund apply.
   Return to employment following any period of disability shall require attending physician statement(s) which must list physical or other limitations, if any, for consideration by management of COS. All such returns shall be coordinated through the Mayor.
   Only full-time employees may qualify for a medical leave of absence.
