Nothing in this chapter and any action or failure to act under this chapter shall or may be construed to:
(A) Impose any liability on the town, or its departments, agencies, offices or employees for the recovery of damages; or
(B) Relieve any person engaged in a land disturbing activity of duties, obligations, responsibilities or liabilities arising from or incident to operations associated with such activity, or imposed by provisions of this chapter or the laws and regulations pursuant to which it was adopted.
