§ 93.05 BURNING OF LEAVES, DEBRIS AND THE LIKE.
   (A)   No person shall burn any leaves, tree limbs, trash, refuse, debris or any other matter outside of any house or other structure within the town except during daylight hours and then only if such material is burned in a suitable metal incinerator of a type meeting the approval of the Chief of the Fire Department; provided, that whenever the material to be burned exceeds the quantity that can be accommodated by such incinerator or is of such a nature that cannot be accommodated by such incinerator, written permission to burn such material shall be procured from the Chief of the Fire Department, and such burning shall be done only under the direction and supervision of the Fire Department during daylight hours and under such other conditions to site, time and supervision as the Chief of the Fire Department shall direct.
   (B)   No building materials are to be burned at all per state and County Department of Health and Environmental Control regulations. Permits are to be issued to contractors or individuals acting in the capacity of contractors for themselves for land clearing purposes. The maximum size materials to be burned shall not exceed eight inches in diameter and shall not include stumps, tires, or other material of a like nature. Fire size shall be easily manageable and shall not exceed fifteen feet in diameter nor over approximately eight feet in height. Chief of the Fire Department will have the right to set such conditions as to the manner, time and site of burning on the permit to be issued. Failure to comply with the regulations set forth herein and on the burning permit shall constitute due cause for revocation of the permit or burning privileges in the town and shall be a violation of this section.
