(A) Intent.
(1) The M-U Multiple Use District is established as a district in which the primary use of the land is primarily for single- and multi-family residential and agricultural purposes, due to the potentially adverse impact of multi-family projects.
(2) All multi-family projects which contain five or more dwelling units shall be considered a residential planned unit development (RPUD), or a subdivision, and businesses listed below shall be permitted subject to the special use permit review and approval under the conditions specified in this chapter.
(B) Permitted uses. Within the M-U Multiple Use District, a building or land shall be used only for the following purposes:
(1) Single-family dwellings, including manufactured homes;
(2) Multi-family dwellings, not exceeding four dwelling units; and
(3) (a) Customary accessory buildings, structures, and uses, provided the buildings and structures are compatible with the architectural style of the principal structure and conform with the color and materials standards required by this chapter.
(b) Accessory buildings and structures shall be located in a side or rear yard and shall conform with the setback requirements.
(C) Special use permits. Within the M-U Multiple-Use District, the following uses are permitted subject to the issuance of a special use permit from the Board of Adjustment in accordance with the provisions in this section and Chapter 31:
(1) Customary home occupation uses;
(2) Residential planned unit developments which include all multi-family attached or detached units containing five or more dwelling units, and developed on a lot or tract of lots in single ownership, may be issued a special use permit subject to the conditions and review process in §§ 31.06 and 154.086;
(3) Retail businesses, consumer service businesses, public service companies, recreational businesses, public or private offices, and public utility buildings, unless otherwise restricted in the section but excluding those businesses requiring open storage of vehicles, motorized equipment, wrecked vehicles, inoperable vehicles, discarded tires, auto parts, machinery, and construction materials, and manufacturing industries employing ten or more persons unless an approved auto body shop or auto mechanic shop;
(4) Business, professional, and medical offices and financial institutions; and
(5) Private utility structures and facilities, specifically water, sewer, and electric.
(D) Dimensional requirements. Dimensional requirements of the M-U Multi-Family Residential District are as follow.
