§ 130.01 SKI PASS.
   (A)   Purpose. The purpose of this section is to prohibit the use of stolen, fictitious or borrowed ski passes within the village and to prohibit skiing, snowboarding, tubing, or similar activities without a valid ski pass.
   (B)   Definitions. For the purposes of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      SKIING. All winter sports slope activities, including skiing, snowboarding, and tubing, use of alpine and Nordic ski trails, or use of freestyle terrain and passenger tramways, that are administered or operated by a ski area enterprise.
      SKI PASS. A license provided by a ski area enterprise for the purpose of allowing individuals to access terrain or property owned or operated by a ski area enterprise.
   (C)   Use of stolen, fictitious, or borrowed ski pass prohibited. No person shall use a stolen, fictitious or borrowed ski pass for the purpose of obtaining any services from a ski area within the corporate limits of the village.
   (D)   Skiing without a valid ski pass prohibited. No person shall ski at any ski area within the corporate limits of the village without a valid ski pass.
   (E)   Providing stolen, fictitious, or loaned ski pass prohibited. No person shall provide a stolen, fictitious, or loaned ski pass to another for the purpose of providing any services to a ski area within the corporate limits of the village.
   (F)   Loaning of season pass to another prohibited. No person shall provide a season pass to another who is not the lawful owner and authorized user of that pass for the purpose of allowing another to obtain any services from a ski area within the corporate limits of the village.
   (G)   Accessing closed lifts and tramways prohibited. No person shall access a closed lift or tramway nor shall any person access a lift or tramway without first having obtained a ski pass from the ski area operator.
   (H)   Enforcement. Any person who violates this section shall be guilty of a Class 3 misdemeanor and fine of up to $500.
