(A) Within 45 days following the original public hearing, unless the application is continued at the request of the applicant, the Planning Commission shall either:
(1) Approve the application;
(2) Approve the application with modifications or conditions; or
(3) Deny the application.
(B) Any person who appeared at the public hearing shall be mailed a copy of the preliminary approval, and may have standing to appeal such preliminary approval to the City Council by filing written notice of appeal with the City Recorder within ten days of mailing of the declaration.
(C) Upon receipt of notice of appeal, the City Recorder shall set the matter down for public hearing before the City Council. On appeal, the City Council may affirm or modify the Planning Commission’s decision.
