901.01 STREET OPENING PERMITS.
   (a)   Supervision by Village Administrator.  
      (1)   All openings made within the street lines or sidewalk removed shall be subject to the directions of and under the supervision of the Village Administrator or his agent. After the work is done, as contemplated by the permit application, the trench or opening shall be refilled, in accordance with the directions of the Village Administrator or his agent; and the concrete, paving or other material shall be properly replaced under the supervision of the Village Administrator or his agent at the applicant's expense except as hereinafter stated.
      (2)   Where openings are made through existing street pavements for the purpose of connecting drains from properties to existing sewers for the benefit of the property owners, the Village shall furnish the material and backfill under the pavement only and repair the pavement at no cost to the abutting property owner. However, any street cuts required for the maintenance or repair of existing connections shall be at the entire expense of the benefited property owner.
   (b)   Protection of Openings. All openings, obstructions or places where the sidewalk is removed shall be carefully guarded, protected or barricaded at all times, and during the night season shall be defined by red colored lights or flares and such other precautions shall be taken as shall be necessary to guard against accidents, and in this respect the Village Administrator or his agent may issue any additional orders as he may deem proper which shall be implicitly and promptly complied with. At all times the work shall be done so as to cause the least inconvenience to property owners and the general public.
   (c)   Return of Deposit. When any work under any permit is completed and all the mandates of this section have been complied with, and all orders of the Village have been fulfilled with respect to the work or the object for which the permit was obtained, the Clerk shall return the excess of the cost to the person who made the deposit; if the deposit be insufficient, to reimburse the Village as herein provided. The Clerk shall certify the deficiency to the Mayor, who shall thereupon notify the applicant of the permit of the deficiency and proceed to collect the same from the permit applicant.
   (d)   Exceptions. Nothing contained in this section shall be deemed applicable to any contract with the Village with respect to street openings.
   (e)   Penalty. Whoever violates any provision of this section shall be fined not more than two hundred dollars ($200.00).
