(a) Requirements. It shall be unlawful to place or maintain backyard chickens in any area unless the following conditions and requirements are met:
(1) A chicken license must be approved by the Village Administrator. A non-refundable application fee of $25.00 shall be submitted with the Chicken license application.
(2) A person is permitted to keep or house chickens on his or her real property located in a residential district, as long as it is a single family residential dwelling, not a mobile home, condominium unit or town house.
(3) A person who keeps or houses chickens on his or her property shall comply with all of the following requirements:
A. No more than six (6) backyard chickens are permitted per dwelling unit.
B. Roosters are prohibited.
C. Other poultry or fowl are prohibited. No person may own or keep any other fowl, including ducks, quail, geese, pigeons or turkeys.
D. The chickens shall be provided with a covered enclosure and must be kept in the covered enclosure or a fenced enclosure at all times, that shall meet the following requirements:
1. The chicken coop and chicken run shall be located in the rear or backyard of a residential property. For purposes of this section, "backyard" means that portion of a lot enclosed by the property's rear lot line and the side lot lines to the points where the side lot lines intersect with an imaginary line established by the rear of the single-family structure and extending to the side lot lines.
2. The coop shall not be located closer than ten (10) feet to any property line of an adjacent property. For purposes of this section, adjacent property means all parcels of property that the applicant's property comes into contact with at one (1) or more points, except for parcels that are legally adjacent to but are in fact separated from the owner's property by a public or private street.
3. The maximum chicken coop size is 100 square feet, except as permitted.
4. The maximum height of the coop shall be no more than seven (7) feet at the highest point of the roof, except as permitted.
5. The chicken coop and run must be designed to ensure that the health and well-being of the animal is not endangered by the manner of keeping or confinement.
E. Chicken coops and chicken runs shall be maintained and shall be regularly cleaned to control dust, odor and waste and not constitute a safety hazard, or health problem to surrounding properties.
(b) Commercial Uses Prohibited. Chickens shall be kept as pets for personal use only. No person shall sell or barter eggs or engage in chicken breeding or fertilizing production for commercial purposes. The slaughtering of chickens in prohibited.
(c) Penalties for Violation. If the regulations set forth by the Village of Stryker are not complied with, the license may be revoked within ten (10) business days' notice by the Village Administrator. Once a permit is revoked a permit will not be reissued for three (3) years.
