2-2-3: FOREIGN FIRE INSURANCE COMPANIES:
   A.   Tax Imposed: All corporations, companies or associations, not incorporated under the laws of the state, and which are engaged in effecting fire insurance within the village, shall pay to the village treasurer, for the maintenance, use and benefit of the fire department thereof, two percent (2%) of the gross receipts of the premiums on fire insurance effected or agreed to be effected in the village, by or with such corporation, company or association.    B.   Agent's Account: Every person who shall act in the village for or on behalf of such corporation, company or association shall, on or before July 15 of each and every year, render to the village a full, true and just account, verified by his oath, of all the premiums which, during the year ending on the July 1 preceding such report, shall have been received by him, or any other person for him in behalf of such corporation, company or association, and shall specify in such report the amount received for fire insurance.    C.   Payment: Such agent shall pay to the village treasurer, at the time of rendering the above mentioned report, the amount established in subsection A of this section. The corporations, companies or associations represented by such agent are severally chargeable by virtue of this section. (1993 Code p. 122 § 409.2-2; amd. 2006 Code)
   D.   Late Reports And Payments: If such account is not rendered on or before the day mentioned herein for that purpose, or if the said tax shall remain unpaid after that day, it shall be unlawful for any corporation, company or association so in default to transact any business in the village until the said requisition shall have been fully complied with, but this subsection shall not relieve any company, corporation or association from the payment of any risk that may be taken in violation thereof.    E.   Penalty: Any person violating the provisions of the section shall be subject to indictment under the laws of the state made and provided for such breach. (1993 Code p. 122 § 409.2-3)
