167.09 APPOINTMENTS.
   (a)   Entry Level Appointments. When a position in the competitive or unskilled labor classes of the classified service is to be filled the appointing authority shall notify the Civil Service Commission of that fact. The Commission shall certify to such authority the names of the ten persons receiving the highest grade on the eligible list for the class or grade to which such position belongs, or the top twenty-five percent (25%) of such list, whichever is greater. The appointing authority may appoint one of the ten persons certified to him or her to such position. In the case of lateral transfer of police officers or police dispatchers, the Commission shall certify to the appointing authority the name of the person or persons based on the total months of full-time experience as a certified police officer or dispatcher.
   (b)   Promotional Appointments. When a promotional position is to be filled the appointing authority shall notify the Civil Service Commission of that fact. The Commission shall certify the names of three persons receiving the highest grade on the eligible list for the class or grade to which such position belongs. The appointing authority may appoint one of the three persons certified to him or her to such position.
