167.06 RULES OF THE COMMISSION.
   The rules of the Civil Service Commission shall provide for:
   (a)   The classification and standardization of all positions in the classified service.
   (b)   Open competitive written examinations or a combination of a written exam and assessment center in the competitive class, to test the relative fitness of applicants for such positions.
   (c)   Public notice of the time and place of all competitive examinations.
   (d)   The scoring of examinations including the award of additional credit, in entry level examinations, for educational attainment and military service, and for current employees with no disciplinary record, as determined by the Commission.
   (e)   The creation of eligibility lists upon which shall be entered the names of successful applicants in the order of their standing in such examinations or tests, or in the case of the unskilled labor class, in order of their standing in accordance with evidence-based ratings based upon the factors set forth in Ohio Revised Code §124.11(B)(2) or otherwise approved by the Civil Service Commission.
   (f)   The creation of eligibility lists for entry level lateral transfer candidates in the Division of Police, including dispatchers, based upon the requirements as stated in the rules of the Civil Service Commission.
   (g)   The certification to the appointing authority from the appropriate eligible list to fill a vacancy in an entry level position in the unskilled labor class or the competitive class, of the ten persons (or top twenty-five percent (25%), whichever is greater) standing highest on such list, and for a promotional position, of the three persons standing highest on such list and from this list the appointing authority may fill the vacancy.
   (h)   Temporary employment without examination in the absence of an eligibility list.
   (i)   With reference to Police Department employees, temporary employment in cases of emergency for periods not to exceed four months unless such period is extended by majority vote of the Commission for not more than two months. For all other City employees, temporary employment in cases of emergency for periods not to exceed thirty days.
   (j)   Noncompetitive examinations for appointments to positions requiring peculiar and exceptional qualifications of a scientific, managerial, professional or educational character.
   (k)   Promotion based on competitive examinations and records of efficiency, conduct, military service and seniority. Lists shall be created and promotions made therefrom of eligibles in the same manner as in original appointments. Any advancement in rank or an increase in salary beyond the limit fixed for the grade by the rules shall constitute promotion. Wherever possible, vacancies shall be filled by promotion.
   (l)   Suspension, by the appointing authority, for the purpose of discipline, for a period not to exceed five days at any one time without right of appeal.
   (m)   The discharge or reduction in rank by compensation in the competitive class only after the person to be reduced or discharged has been presented with the reasons for such discharge or reduction specifically stated in writing, and has been given an opportunity to be heard in his own defense. The reason for such discharge or reduction and reply in writing thereto by such employee shall be filed with the Commission.
   (n)   Investigating and keeping a record of the efficiency of officers and employees in the classified service, and for requiring grading and written reports thereto from the supervisor of each employee in the classified service.
   (o)   Preparing, continuing and keeping in its office a complete roster of all persons in the classified service. It shall show, in reference to each person, his name, address, the date of his appointment to or employment in such service, his salary or compensation, the classification which he holds, the nature of the duties thereof, and in case of his removal or resignation, the date of the termination of such service.
   (p)   Registration and ranking of applicants for positions in the unskilled labor class.
   (q)   The adoption of such other rules, not inconsistent with the foregoing, as the Commission may deem necessary and proper. (Ord. 2023-74. Passed 5-22-23.)
