(a) When a vacancy occurs in any position in which appointment requires confirmation by City Council, the Mayor may retain a professional firm or individual to perform the duties of the position until such time as a permanent replacement is nominated by the Mayor and confirmed by Council, but in no event exceeding ninety (90) days. Every employment relationship, employment contract, or professional services contract authorized by this Section will be documented in writing and will specify that it terminates upon confirmation of a replacement director or ninety (90) days after its effective date, whichever occurs first, unless the Council authorizes an extension or a term contract. In addition, any employment relationship, employment contract, or professional services contract authorized by this Section may be terminated immediately upon the affirmative vote of three-fourths (¾) of the members of Council. Persons filling a position or performing services for the City under this section:
(1) Must possess the minimum qualifications specified in the City Charter for the position being performed;
(2) Will be deemed independent contractors and will not be entitled to benefits, paid leave or retirement contributions;
(3) Will not acquire any tenure in the position that would otherwise be acquired under Section 3.08 of the City Charter; and
(4) Shall not have been previously denied confirmation or reappointment by the Council.
