(a) An Emergency Vehicle Preemption System (EVPS) is a traffic control system designated for use by emergency vehicles to improve traffic movement by temporarily taking control of signalized intersections.
(b) The EVPS may be activated by authorized personnel for periodic testing, maintenance or repair of the system. Sirens and flashing red lights need not be activated except when the test vehicle exceeds the posted speed limits.
(c) Except as provided in subsection (d) hereof, it shall be unlawful for any person to possess a traffic control signal preemption device.
(d) The provisions of this section shall not apply to the operator, passenger or owner of any of the following authorized emergency vehicles, in the course of such person’s emergency duties:
(1) Publicly owned fire department vehicles;
(2) Publicly owned police vehicles; or
(3) Emergency response vehicles operated by any municipality while such vehicle is operating under emergency conditions.
