941.151 PAYMENT OF RUBBISH PICK-UP FEES FOR CERTAIN SUBSCRIBERS BY THE CITY.
   (a)   Council authorizes the payment of the standard rubbish service fee of the City contractor for those subscribers:
      (1)   Whose adjusted gross income in the preceding tax year was one and three quarters times the annual Federal Poverty Level guidelines substantially similar as attached in Exhibit “A” to Ordinance 2010-108, the Streetsboro Fee-Paid Rubbish Application;
      (2)   Who do not owe the City contractor for any prior rubbish service; and
      (3)   Who have been a resident of the City for at least one year prior to application.
   Extraordinary rubbish service fees, as defined in the City rubbish contract, will be the responsibility of the subscriber and not the City, except that the City will pay in addition to the standard rubbish service fee the fee for door-side service for those physically-impaired subscribers eligible for such service under the City rubbish contract.    (b)   All subscribers eligible for standard fee-paid rubbish service under subsection (a) hereof must submit their application to the Mayor before May 15 of each year, on a form substantially the same as attached to Exhibit “A” to be made available through the Mayor’s Office. All applications must contain proof of head of household adjusted gross income by attaching a copy of the relevant portion of Forms 1040EZ, 1040, or 1040A, or, for whose otherwise eligible subscribers who were not required to file a federal income tax return, by so indicating on the application. The fee-paid rubbish program shall run from July 1 through June 30 based on the previous tax year adjusted gross income.
   (c)   By May 31 of each year that this section is in effect the Mayor shall certify to the Finance Director a list of those subscribers eligible for fee-paid rubbish service to be paid from funds appropriated by the City. The Mayor shall send a postcard notice of application deadline (May 15) to those subscribers who participated in the previous year fee-paid rubbish program but did not submit an application by April 30 for the current program.

   (d)   Income Exemption. Council creates an exemption from the $40,000 household gross income requirement set forth in subsection (a) hereof, as follows: Those subscribers who have experienced a substantial decrease in household gross income in the year of application from the preceding tax year, which decrease places them under the subsection (a) requirement and they otherwise are eligible under the program, may apply to a committee comprised of the Mayor and two (2) Council members for exemption from the requirements of subsection (a) hereof under such terms and conditions as a majority of such committee deems fair and equitable under the circumstances. The decision of the committee shall apply for the year of application only. If for any reason it is determined that an applicant granted an exemption under this subsection (d) was not eligible for such exemption, the applicant will be required to reimburse the City for any fees it paid on behalf of that applicant under this program and may also be subject to subsection (c) hereof.

   (e)   The City reserves the right to suspend or cancel this fee-paid rubbish pick-up program at any time and without prior notice; and that only those subscribers whose name appears on the list certified to the Finance Director each year shall have such fee paid by the City. This section confers no rights to fee-paid rubbish pick-up on any subscriber unless and until their name is so certified to the Finance Director. The City, its officials and officers, will not be liable for any errors in administering this program.
   (f)   Each applicant under this program must swear or affirm the truth of the statements in the application, and any applicant knowingly submitting a false application will be required to reimburse the City for any fees it paid on behalf of that applicant under this program and may be subject to prosecution for perjury under Ohio R.C. 2921.11.
   (g)   The Finance Director be, and hereby is, authorized to encumber and pay funds necessary to meet this obligation from the proper line item in accordance with this section, and is directed to attach his certificate to Ordinance 2004-35 annually.
