909.02 INITIAL CONSENT.
   Initial consent for occupancy or use of a right-of-way is hereby granted for all lines, poles, pipes, conduits, ducts, equipment, or other appurtenances, structures, or facilities of a public utility or cable operator that, on July 2, 2002, lawfully so occupied or used a right-of-way. However, such consent does not relieve a public utility or cable operator or any other person of compliance with this chapter with respect to installing any facilities or equipment in the public right-of-way, obstructing any portion of a public right-of-way, or excavating in a right-of-way on or after the effective date of this chapter.
