Any person violating any provision of this chapter shall be guilty of a misdemeanor of the fourth degree for the first offense with a maximum sentence of thirty (30) days or $250.00; a misdemeanor of the third degree if a second offense takes place within one (1) year with a maximum sentence of sixty (60) days or $500.00; a misdemeanor of the second degree if a third offense takes place within one (1) year of the first with a maximum sentence of ninety (90) days or $750.00; and, finally, a misdemeanor of the first degree if a fourth offense takes place within one (1) year of the first with a maximum sentence of six (6) months or $1,000.
