(a) No person, with purpose to deprive the City of water, shall knowingly obtain or exert control over the City’s water supply in any of the following ways:
(1) Without the consent of the City;
(2) Beyond the scope of the City’s authorization;
(3) By deception.
(b) Whoever violates this section is guilty of theft of water, a misdemeanor of the second degree. Each successive violation shall be a misdemeanor of the first degree. Any equipment utilized to unlawfully tap shall be subject to summary seizure and forfeiture if such forfeiture is order by the Court.
