521.08 LITTERING AND DEPOSIT OF GARBAGE; CONTAINERS. 
   (a)    No person shall, except in the manner provided in subsection (c) hereof, place or dispose of in any manner, upon any public property or upon the premises of another, any paper, trash, garbage, waste, rubbish, refuse, junk or nonreturnable containers.
   (b)    No person shall place or dispose of in any manner upon any private property or land which is used for the accommodation of the public or to which the public is invited or licensed to use in the sale of goods and services, any paper, trash, garbage, waste, rubbish, refuse, junk or nonreturnable containers except in the manner provided in subsection (c) hereof.
   (c)    Each owner, tenant or occupant of premises shall provide and maintain a substantial can, box, barrel or other receptacle for the deposit of any paper, trash, garbage, waste, rubbish, refuse, junk or nonreturnable containers. Each container shall be so constructed as to prevent its contents from being scattered by the wind and from being susceptible to catching fire or to dropping its contents when moved.
   (d)    Whoever violates this section is guilty of a minor misdemeanor for a first offense; on each subsequent offense such person is guilty of a misdemeanor of the fourth degree.
