10-3-7: ACCEPTANCE OF REQUIRED LAND IMPROVEMENTS:
   A.   Acceptance Of Improvements By Resolution: The village board shall accept by resolution all public improvements upon: 1) completion of all buildings within the subdivision phase or unit; 2) completion of all improvements; 3) the passage of at least one winter between the construction of the pavement binder course and the construction of the surface course; 4) completion of a comprehensive inspection by the director of public works of all improvements and landscaping; 5) completion of all necessary repairs by the developer; 6) certification by the director of public works that all the improvements are completed in accordance with this code and any applicable planned unit development ordinances; 7) tender of a bill of sale for all the improvements to be accepted; 8) completion of all park sites within the phase or unit and written acceptance by the Streamwood park district; 9) completion of all wetland mitigation areas, reforestation areas, and/or woodland mitigation areas; 10) the unit or phase is not being used as construction access for additional or future construction; 11) the elimination of all construction traffic from all parts of the area to be accepted; and 12) a deed and clear title policy for any property to be conveyed to the village prepared in a form acceptable to the village attorney. The comprehensive inspection shall include all improvements required by this code or planned unit development ordinance, including, but not limited to, streets, streetlights, storm sewer system, sanitary sewer system, water system, curb, sidewalk, driveway aprons, retaining walls, grading, required turf, detention and/or retention areas, all trees and shrubs and other plant material installed in woodland mitigation areas, wetland mitigation areas, reforestation areas, on public property, and all trees, shrubs and other plant material installed as part of a planned unit development or subdivision landscape plan for public, common area and foundation plant material. The inspection shall not take place between November 1 and March 15. As a result of the inspection the director of public works shall furnish a list of the necessary repairs to the developer. If all the repairs are not completed by December 31 of the same year, a new inspection and list shall be made the following year. Unless approved by the director of public works, the surface course of all streets shall not be constructed until completion of all other necessary repair work. The developer shall supply two (2) sets of as built prints, and one set of as built mylars and the digital CAD files in a format as approved by the village engineer. As builts are required prior to final inspection. As built drawings shall show the location with measurements of all B-boxes, water valves, fire hydrants, sewer services and manholes, all elevations of the manhole rims, pipe inverts and corresponding pipe slopes. All building top of foundation and basement floor elevations must be shown. All public improvements shall be guaranteed against defects in material and workmanship for two (2) years following acceptance by the village board. All trees and shrubs and other plant material installed in woodland mitigation areas, wetland mitigation areas, reforestation areas, on public property, and all trees, shrubs and other plant material installed as part of a planned unit development or subdivision landscape plan for public, common area and foundation plant material shall be guaranteed for two (2) years after acceptance by the village board. All replaced landscape material shall comply with subsection 10-6-9E of this title.
   B.   Final Plat Approval Not Acceptance Of Improvements: If any final plat of subdivision contains public streets or thoroughfares which are therein dedicated as such, whether located within the corporate limits of the village, or all or in part outside thereof or contains existing streets located outside of said corporate limits, the approval of the final plat by the board of trustees or the subsequent annexation of the property to the village shall not constitute an acceptance thereon or therein, irrespective of any act or acts by an officer, agent or employee of the village with respect to such streets or improvements.
   C.   Guarantee Period: Upon acceptance by the village board, the owner or his assigns (developer) shall post a letter of credit, surety bond or cash deposit equal to ten percent (10%) of the original amount to guarantee any repairs due to defects in material or workmanship during the guarantee period. The guarantee period shall be two (2) years for all public improvements. All trees and shrubs planted in parkways, islands, medians, or woodland mitigation areas shall be guaranteed for two (2) years. At least sixty (60) days prior to the end of the guarantee period, the director of public works shall inspect the accepted area and furnish a list of necessary repairs to the owner. Concerning trees, each year during the guarantee period, the director of public works shall inspect the accepted area and furnish a list of necessary tree replacements to the owner.
