10-2-3: DEDICATION OF LAND FOR PUBLIC USE:
   A.   Procedure:
      1.   The village shall notify all affected public bodies as required by law in writing of any formal application for annexation or development of lands within or adjacent to the village of Streamwood. (Ord. 2010-27, 12-2-2010)
      2.   Upon submission of a preliminary plat of subdivision to the village, a duplicate copy of said plat shall be filed with the park district. The park district shall comment and make written recommendations to the planning and zoning board on said preliminary plat within sixty (60) days of receipt of said preliminary plat. In the event that the park district has not made written recommendations within sixty (60) days, it shall be assumed that the park district will accept cash in lieu of land on said development. No preliminary plat shall be approved until subsequent to the sixty (60) day review period unless otherwise waived in writing by both the park district and applicant. (Ord. 2010-27, 12-2-2010; amd.       3.   During said sixty (60) day review period and initial approval of the preliminary plat, the village shall notify the park district in writing of any suggested modifications, changes or amendments to said preliminary plat. In the event of substantial modifications, changes or amendments, the park district shall have an additional thirty (30) days for written comment. Substantial modifications, changes or amendments with reference to this section shall be defined as changes in access, size, character or location of designated park land or a change of density in the development.
   B.   Acceptance Or Refusal Of Designated Land:
      1.   Acceptance Of Designated Land: When a final plat of a subdivision has been approved by the village board and all other required approvals are obtained and the plat is recorded, that approval shall constitute acceptance for the purpose designated on the plat of all lands shown on the plat as dedicated to the public, excepting street dedications which shall be accepted only after inspection and recommendation by the village engineer.       2.   Refusal Of Designated Land: Whenever a preliminary plan includes a proposed dedication of land to public use and the planning and zoning board finds that such land is not required or not suitable for public use, the planning and zoning board may either refuse to approve such dedication or require the rearrangement of lots in the proposed subdivision to include such land.       3.   Time For Completion Of Improvements: All lands required to be dedicated hereunder, shall be fully improved in accordance with the requirements of subsection 10-2-5H of this chapter, upon closing of the sale of fifty one percent (51%) of the total lots or units in said development.
