The following words and terms, wherever they occur in this title, shall be construed as herein defined:
ALLEY: A public right of way which affords a secondary means of access to abutting properties. An alley shall not be considered a street.
ARTERIAL: See definition of Street, Major.
BLOCK: A tract of land bounded by streets, or by a combination of streets and public parks, golf course, cemeteries, railroad rights of way, or shorelines of waterways. A block may be located, in part, beyond the boundaries of the village of Streamwood.
BORINGS, SOIL: Examination and analysis of the subsoil conditions of a specific parcel of land by drilling.
BUILDING: Any structure built for the enclosure, shelter, support, or protection of person, animals or property of any kind and which is permanently affixed to the ground. The term "building" shall not include fences.
BUILDING PERMIT: A permit issued by the village for the erection or alteration of a construction, structure or building.
CERTIFICATION: The specific inspections and test where required, have been performed and such tests comply with the applicable requirements of this title.
COMPREHENSIVE PLAN: The composite of the functional and geographic elements of the official comprehensive plan of the village and environs or any segment thereof, in the form of plans, maps, charts, text of reports, implementing ordinances, and the official map.
CORINGS; PAVEMENT: Examinations and analysis of the completed surface and/or subsurface of a finished pavement by removing a core by drilling.
CROSSWALK: Any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface.
CUBIC YARDS: The amount of material in excavation and/or fill measured by the method of "average and areas".
CUL-DE-SAC: A minor street having one open end and being permanently terminated by a vehicular turnaround.
CURB: The permanent edge of a paved surface designed to separate the vehicular travelway from the landscaped parkway.
DAM: A structure built of earth, masonry, concrete or other material, the function of which is to prevent the flow of water from a reservoir.
DATUM PLANE: A reference point from which elevations are measured. The datum plane is mean sea level as established by the United States geodetic survey (USGS).
DETENTION BASIN: A covered or uncovered reservoir designed to hold an excessive accumulation of stormwater so as to reduce peak flow in a stormwater drainage system.
DEVELOPER: Any person, group of persons, organizations, etc., whose concern and desire is to improve land in accordance with the development regulations of the village. See definition of Subdivider.
DITCH, OPEN: An uncovered channel constructed as part of a stormwater drainage system designed to contain, collect and direct a flow of stormwater.
DRAINAGE SWALE: A turf drainage ditch of shallow depth with side slopes not exceeding one to twelve (1:12).
DRIVEWAY: An entrance which provides vehicular access to either public or private property.
EASEMENT: A recorded agreement whereby a property owner grants the use of air, land or mineral right for a specific purpose.
ELEVATIONS: The vertical distance measured from a point on the ground to the datum plane.
EMBANKMENT: A side of a reservoir formed by the cutting or grading of earth.
ENGINEER, DESIGN: A professional engineer, registered in the state of Illinois, retained by a subdivider to prepare designs and specifications for required land improvements within a subdivision.
ENGINEER, VILLAGE: A professional engineer, registered in the state of Illinois, who has been duly appointed as village engineer.
ENVIRONMENTALLY SENSITIVE AREA (ESA): Environmentally sensitive areas (ESA) are those areas which have significant natural features such as large trees or wetlands. These areas require special care be taken during any development. Wetland mitigation shall be in accordance with chapter 8 of this title.
EXCAVATION: Any act by which organic matter, earth, sand, gravel, rock or any other similar material is cut into, dug, quarried, uncovered, removed, displaced, relocated or bulldozed and shall include the conditions resulting therefrom.
EXISTING GRADE: The vertical location of the existing ground surface prior to excavation or filling.
FARMLAND: Land actively used for commercial agricultural purposes.
FILL: Any act by which earth, sand, gravel, rock or any other material is deposited, placed, replaced, pushed, dumped, pulled, transported or moved by man to a new location and shall include the conditions resulting therefrom.
FIRE LANES: Lanes designated for fire protection as required by the president and board of trustees.
FRONTAGE: The length of the front property line of the lot, lots or tract of land abutting a public street, highway or road.
FRONTAGE ROAD: See definition of Street, Marginal Access.
GRADE: The slope of the land, road, street or other public way expressed in percent, or average level of the finished surface of the ground adjacent to the exterior wall of a structure.
GRADING: Excavation or fill or any combination thereof and shall include the conditions resulting from any excavation or fill.
GROSS LAND AREA: The entire area of a development including lots, streets and alleys, measured to the centerline of any bounding streets.
HIGHWAY SEPARATION: A crossing of two (2) highways at different levels, one carried over the other by a structure.
IDOT: Illinois department of transportation.
LAND DIVISIONS: Any division of a parcel of land into two (2) or more parcels for the purpose of sale or development that is not a "subdivision" as herein defined.
LAND IMPROVEMENT: Any sanitary sewer system, storm sewer system, water supply and distribution systems, roadway, parkway, sidewalk, pedestrianway, no access strip, off street parking area, soil conservation, or other improvement which the village may require under this title.
LAND SURVEYOR: A registered surveyor of the state of Illinois.
LOT: A single tract or parcel of land within a block under unified ownership or control and as further defined by title 11 of this code.
LOT, CORNER: A lot situated at the intersection of two (2) streets, the interior angle of such intersection not exceeding one hundred thirty five degrees (135°).
LOT, THROUGH: A lot having frontage on two (2) parallel or approximately parallel streets, and which is not a corner lot.
MWRD: Metropolitan water reclamation district.
MEDIAN STRIP: A dividing section, barrier or unpaved strip which separates two (2) roadways.
NO ACCESS STRIP: A land area at least twelve feet (12') wide along the rear lot line of a through lot and abutting a thoroughfare within which no vehicular driveway shall be permitted.
OFFICIAL MAP: The map showing the streets, highways and parks theretofore laid out, adopted and established by law and any amendments or additions thereto resulting from the board of trustees action or the approval of subdivision plats.
PARCEL: All contiguous land in one ownership.
PARKWAY: That portion of the street right of way between the sidewalk and curb.
PEDESTRIANWAY: A right of way across or within a block designated for pedestrian use.
PERMITTEE: Any person to whom a site development permit is issued.
PERSON: Any person, firm or corporation, public or private, the state of Illinois and its agencies or political subdivisions, and the United States Of America, its agencies and instrumentalities, and any agent, servant, officer or employee of any of the foregoing.
PLAN, PRELIMINARY: A detailed map, drawing, or chart on which the subdivider's design for the subdivision of land is presented and which he submits in form for review and approval but not for recording.
PLAN SKETCH: A general map or drawing on which the subdivider's design for the subdivision of land is presented for discussion purposes prior to the preparation of the preliminary plan.
PLANNED UNIT DEVELOPMENT: A unique development of a tract of land, under unified ownership or control, in accordance with the provisions of this title.
PLAT, FINAL: A map, drawing or chart on which the subdivider's plan for the subdivision of land is presented and which he submits for final approval and intends to record in final form.
PUBLIC UTILITY: Any person, firm or corporation, municipal department, board or commission, duly authorized to furnish, and furnishing under government regulations, to the public: gas, steam, electricity, sewage disposal, communication, telegram, transportation or water.
REFORESTATION: Restocking of existing forests, woodlands or any number of trees which have been depleted.
REMOVED: Cutting vegetation to the ground, or complete extraction of stumps, etc., or killing by spraying.
RESIDUE AREA: A residue area is that portion of a planned development not platted as residential lots or designed for dedication as streets or alleys.
RETENTION BASIN: A permanent body of water.
ROADWAY: The paved area within a street right of way intended for vehicular traffic, including all curb and gutter facilities.
SETBACK: The minimum horizontal distance between a lot line and the nearest side of a structure to such lot lines.
SIDEWALK: That portion of the street right of way designated for pedestrian use.
SITE: A lot or parcel of land, or a contiguous combination thereof, where grading work is performed as a single unified operation.
SITE DEVELOPMENT: Altering terrain and/or vegetation.
SOIL AND WATER CONSERVATION DISTRICT: The North Cook County soil and water conservation district.
SOIL TESTING: Determination and analysis of the subsoil conditions of a specific land area by use of soil borings.
STANDARD SPECIFICATIONS FOR ROAD AND BRIDGE CONSTRUCTION: Current edition of the "Standard Specifications For Road And Bridge Construction" (SSRB) as adopted by the Illinois department of transportation.
STREET: A public or private right of way or easement which affords a primary means of access to abutting properties. An alley shall not be considered a street.
STREET, BOULEVARD: A street developed to two (2) lane, one-way pavements, separated by a median.
STREET, HALF: A street of less than the total required width along one or more property lines of a subdivision.
STREET, LOOP: A minor street of short length with two (2) openings to traffic beginning from the same street, and projecting parallel to each other and connecting at their termination by a loop.
STREET, MAJOR: A street of considerable continuity which serves or is intended to serve a major traffic artery connecting various sections of Streamwood.
STREET, MARGINAL ACCESS: A minor street which is parallel and adjacent to highways and major streets and which provides access to abutting properties and protection to local traffic from fast, through moving traffic on the highways and major streets.
STREET, MINOR: A street primarily used as access to abutting properties.
STREET, PRIVATE: An undedicated street which is privately owned and maintained, or an easement of access benefiting a lot or parcel.
STREET, PUBLIC: Any major or secondary street or minor street which is shown on the subdivision plat and is or is to be dedicated to public use.
STREET, SECONDARY OR COLLECTOR: A street which carries traffic from minor streets to the major street system, including the principal entrance streets of residential development and streets for circulation within such development.
STREET, TURNAROUND: A short boulevard street permanently terminated by a vehicular turnaround.
SUBDIVIDER: The person or persons responsible for preparing and recording the plats of this subdivision and for carrying out all appropriate requirements relating thereto as outlined in this title.
SUBDIVISION: A described tract of land which is to be, or has been, divided into two (2) or more lots or parcels, any of which is less than five (5) acres in area, for the purpose, whether immediate or future, of transfer of ownership or building development, including all public streets, alleys, ways for public service facilities, parks, playgrounds, school grounds or other public grounds, and all the tracts, parcels, lots or blocks, and numbering of all such lots, blocks or parcels by progressive numbers, giving their precise dimensions. The term subdivision includes resubdivision, consolidation, and where it is appropriate to the context, relates to the process of subdividing or to the land subdivided; provided, however, that the following shall not be considered a subdivision and shall be exempt from the requirements of this title.
A. The division or subdivision of land into parcels or tracts of five (5) acres or more in size which does not involve any new streets or easements of access, or otherwise deemed by the president and board of trustees.
B. The sale or exchange of parcels of land between owners of adjoining and contiguous land.
C. The conveyance of parcels of land or interest therein for use as right of way for railroads or other public utility facilities which does not involve any new streets or easements of access.
D. The conveyance of land owned by a railroad or other public utility which does not involve any new streets or easements of access.
E. The conveyance of land for highway or other public purposes or grants or conveyances relating to the dedication of land for public use or instruments relating to the vacation of land impressed with a public use.
F. Covenants made to correct descriptions in prior conveyances.
G. The division of existing lots of record into no more than two (2) parts and not involving any new streets or easements of access, provided that the two (2) parts meet the requirements of the applicable zoning ordinance (title 11 of this code) and all other ordinances of the village.
H. The division of lots or blocks of less than one acre in any recorded subdivision which does not involve any new streets or easements of access, provided that all requirements of this title and the zoning ordinance (title 11 of this code) are complied with.
I. The sale of a single lot of less than five (5) acres from a larger tract when a survey is made by a registered surveyor; provided however, that this exemption shall not apply to the sale of any subsequent lots from the same larger tract of land, as determined by the dimensions and configuration of the largest tract on October 1, 1973, and provided that all requirements of this title and the zoning ordinance (title 11 of this code) are complied with.
VACANT: Land on which there are structures or only structures which are secondary to the use or maintenance of the land itself.
VILLAGE: The village of Streamwood, Illinois.
WATER LEVEL, CONSTANT: The minimum depth of water designed to be contained at all times within a retention basin.
WATER LEVEL, OCCASIONAL: The maximum depth of water designed to be contained within a retention or detention basin during periods of peak stormwater flow.
ZONING ORDINANCE: The village zoning ordinance, as amended (title 11 of this code). (Ord. 2010-27, 12-2-2010)
