7-10-6: NOISES PERMITTED:
The following noises are permitted subject to the procedures set forth below:
   A.   Loudspeakers, Amplifiers, Public Address Systems, And Similar Devices On Public Streets:
      1.   A person may use, operate, or cause to be used or operated, a loudspeaker, amplifier, public address system, or similar device upon or along the public right of way in accordance with a permit obtained pursuant to this subsection A.
      2.   Any person desiring a permit to use, operate, or cause to be used or operated, a loudspeaker, amplifier, public address system, or similar device shall make a written application to the director of community development stating the applicant's name, the length of time, and the place(s) where the device(s) shall be located. The applicant shall also pay the permit fee as provided in subsection A3 of this section. If the director of community development grants a permit pursuant to this subsection A, and the permit fee provided in subsection A3 of this section has been paid, the director of community development shall issue to the applicant a permit for the purpose and time specified in the application.
      3.   The fee for permits granted under this subsection A shall be one hundred dollars ($100.00) per day for the use of any loudspeaker, amplifier, public address system, or similar device to be operated.
   B.   Construction Or Repair Of Buildings, Excavation Of Streets And Highways:
      1.   After having first obtained written permission as provided in this subsection B, a person may, in nonemergency situations, undertake the construction or repair of any buildings, or the excavation of streets or highways, between the hours of nine o'clock (9:00) P.M. and six o'clock (6:00) A.M. on weekdays, and between the hours of six o'clock (6:00) P.M. and eight o'clock (8:00) A.M. on weekends.
      2.   Any person desiring to undertake the construction or repair of any buildings, or the excavation of streets and highways, pursuant to this subsection B, shall make a written application to the director of community development stating the applicant's name, the specific work to be done, the location of the work to be done, and the time required to complete the work. The director of community development may, at his discretion, issue written permission to undertake the construction or repair of any building, or the excavation of streets and highways, between the hours of nine o'clock (9:00) P.M. and six o'clock (6:00) A.M. on weekdays, and between the hours of six o'clock (6:00) P.M. and eight o'clock (8:00) A.M. on weekends, if he determines that the public health and safety will not be detrimentally affected by the noise created by the work performed. Permission granted under this subsection shall be for a period of no more than three (3) days, and may be renewed for one period of no more than three (3) days. (Ord. 2010-12, 7-15-2010)
