4-3-19: DEFACEMENT OF PROPERTY LESS THAN FIVE HUNDRED DOLLARS ($500.00) OR INTERFERING WITH PUBLIC OR PRIVATE PROPERTY:
   A.   A person commits criminal defacement of property when the person defacing, deforming, or otherwise damaging the property by the use of paint or any other similar substance, or by the use of a writing instrument, etching tool, or any other similar device. It is an affirmative defense to a violation of this Section that the owner of the property damaged, consented to such damage.
   B.   No person shall cut, injure, mark or deface any building not his own or any tree, grass, shrub or walk in any square, street or public park, or any sewer, water pipe or hydrant laid or placed by the Village.
   C.   No person shall string wires in the Village and put them up in such a manner as to damage or injure any tree standing in any street, park or alley of the Village, either by abrasion caused by contact of such wires with any such tree, or by burning the branches or trunk of any such tree by electric current conducted by such wires, or by cutting or climbing into or upon any such tree when putting up or repairing such wires.
   D.   It shall be unlawful for any person other than one authorized by the Director of Public Works and Buildings to do or suffer to be done any act or thing the effect of which would be to divert storm waters from the course of drainage established in accord with engineering plans approved by the Village.
   E.   It shall be unlawful for any person other than one authorized by the Director of Public Works and Buildings to tamper with or suffer to be tampered with manhole covers or walls of manholes or to throw anything into a manhole. (1994 Code; amd. Ord. 2021-18, 10-21-2021)
