523.01 DEFINITIONS.
   For the purpose of this chapter, the following words and phrases shall have the following meanings ascribed to them respectively.
   (a)   "Abate" means to lessen, to put an end to or to do away with a public nuisance.
   (b)   "Abatement" means the removal or reduction of a public nuisance.
   (c)   “Board” means the Administrative Hearing Board organized under Section 181.
   (d)   “Chairperson” means the chairperson of the Administrative Hearing Board.
   (e)   "City" means the City of Stow.
   (f)   "Council" means the Stow City Council.
   (g)   "County" means the County of Summit.
   (h)   "Mayor" means the Mayor of the City of Stow.
   (i)   "Owner" means the owner of record as shown on the current tax list of the Auditor of Summit County, Ohio; the mortgage holder of record, if any, as shown in the mortgage records of the Recorder of Summit County, Ohio; and any purchases under a land contract of record in either the miscellaneous records or the mortgage records of the Recorder.
         (j)   "Private property" means real estate not owned by the City.
   (k)   "Public nuisance" means:
      (1)   Any of the following items on private property:
         A.   Weeds or noxious weeds which include, but are not limited to, those as defined in Section 521.005.
         B.   Grass in excess of eight inches; or
         C.   Roots of trees which obstruct any portion of a sewer located on City property or within City easements; or
         D.   Shrubs or bushes located within twenty feet of the intersection of two or more streets abutting either the sidewalk or the normal sidewalk location if the shrubs or bushes exceed two feet in height above the surface of either the sidewalk or the normal sidewalk location; or
         E.   A tree, plant, bush or shrub, the branches or trunk of which obstruct or impede traffic on any street or public place. Branches overhanging within nine feet of the surface of any sidewalk or within thirteen and one-half (13½) feet of the surface of any street shall be deemed prima facie to obstruct or impede traffic thereon; or
         F.   Violations of Section 521.01 through 521.20.
