(a) No minor under the age of eighteen years shall be in, upon or about any public street, public ground or business establishment open to the public, or be in or upon a motor vehicle thereon, within the City between the hours of 11:00 p.m. and 6:00 a.m. of the following day Sunday through Thursday or between the hours of 12:00 midnight and 6:00 a.m. of the following day on Friday and Saturday unless that minor is accompanied by his or her parent, guardian or person having the legal custody and care of that minor child, or unless accompanied by a responsible adult person over the age of twenty-one years who is in the constant and continual company, control and supervision of such a minor child.
(b) No person shall fail to furnish any City police officer or other duly authorized officer with proof or verification of his age upon request to do so. If the proof or verification is not immediately available, the person shall be detained by the police officer until the proof or verification of age can reasonably be ascertained.
(c) Whenever any police officer charged with the duty of enforcing the laws of the State and the City discovers or has called to his attention any minor found within the City contrary to the terms of this section, he shall detain that minor and cause immediate personal notice thereof to be given to the parent or guardian of that minor and shall discharge that minor only to the parent, guardian or other person having legal control or custody of that minor.
(d) No parent, guardian or other person having the care, custody or control of a minor shall knowingly permit that minor to violate any of the provisions of this section.
(e) Whoever, being a minor, violates any of the provisions of this section shall be dealt with in accordance with juvenile court law and procedure.
(f) Whoever, being an adult, violates any of the provisions of this section is guilty of a misdemeanor of the third degree.
