(a) Application Form. All mobile ice cream vendors wishing to do business within the city of Stow shall have his credentials registered and shall file in duplicate with the Mayor, or the Mayor's designee, a written application on a form to be approved by the Director of Law correctly setting forth the following information:
(1) The full name of the applicant;
(2) His or her address;
(3) His or her birth date, demonstrating the person is at least 18 years of age, height, weight and color of eyes and hair;
(4) The make, model, year and current registration number of the vehicle(s) used by the vendor;
(5) The state of issue of his or her driver's license and the number thereof;
(6) The name, address and phone number of his or her employer, and a contact person therein;
(7) Whether the applicant has even been registered as a sex offender or been convicted of any crime, other than a minor traffic offense, and if so, the date, nature thereof and penalty therefore;
(8) Mobile telephone number; and
(9) A valid Ohio driver's license with photo.
(b) Background Check. All vendors must consent to a background check. Any person who through the mobile ice cream vendor permitting process is discovered to have been convicted of, or who has pled guilty to any criminal offense of the Ohio Revised Code, United States Code, or any other substantially similar state or local provisions that constitutes any theft or fraud offense, any offense of burglary, any offense of violence or any offenses of any sex crime law or statute shall be denied a mobile ice cream vending license. Applicants who have been convicted of or pled guilty or no contest to any serious traffic offense within five years of the application date shall similarly be denied a mobile ice cream vending license.
(c) County Public Health License Required. All vendors must submit proof of Mobile Food License issued by Summit County Public Health at the time of application with the City of Stow and shall keep said license current while operating within the City of Stow. Said license shall at all times be clearly displayed on the vehicle during times of operation.
(d) Insurance Required. All vendors shall carry insurance for the vehicle, business operation and any property or bodily injury that may result from the vendors operation within the City of Stow. The Law Director shall create and administer regulations regarding the amount and quality of insurance required for mobile ice cream vendors but shall at all times require coverage limit minimums of at least $1,000,000 per occurrence. Vendor applicants shall provide adequate proof of insurance coverage to Law Director at the time of application. Licensed vendors shall maintain and carry proof of insurance at all times while operating within the City of Stow. Failure to carry or maintain the required level insurance shall result in a denial of the application or a termination of mobile ice cream vendor license.
(e) Application Fee. Concurrently with the filing of the application, the applicant shall pay a fee of two hundred fifty dollars ($250.00) to compensate for the costs incident to the background examination, registration, issuance of credentials and enforcement of the laws and regulations herein.
(f) License Display. All licensed vendors shall clearly display their City of Stow Mobile Ice Cream Vendor License on the exterior of the vehicle or through their vending window so as to be conspicuously visible to all customers. Vendors shall also carry all personal credentials on their person at all times, including a valid Ohio driver's license and proof of insurance, when operating within the City of Stow.
