173.12 BID OPENING BY REVERSE INTERNET AUCTION.
   (a)   If the City is required by law to purchase services or supplies by competitive sealed bidding or informal competitive bidding, and the City determines that the use of a reverse internet auction is advantageous to the political subdivision, the political subdivision, in accordance with the Ohio Revised Code and any rules and ordinances of the City shall adopt, may purchase services or supplies by reverse internet auction.
   (b)   Except as otherwise provided herein, written or oral notice of any extension shall be given no later than forty-eight (48) hours prior to the original time and date fixed for the opening to all persons who have received or requested specifications. Any modification of the plans or specifications and estimates of cost for the project for which bids are solicited shall be issued and mailed or otherwise furnished to persons who have obtained or requested plans or specifications for the project. If any modification of the plans or specifications and estimates of cost for the project is issued seventy-two (72) hours or less prior to the published time for the opening of bids, excluding Saturdays, Sundays, and legal holidays, the time for opening of bids shall be extended one week. Any notice or modification required by this section may be made by posting the notice or modification on the internet site of the reverse auction and only if the bid documents announce that such notices and modifications will be so posted.
      (1)   No further advertising of bids is required under this section. Any notices required herein may be accomplished by facsimile transmission. Notice shall be complete upon mailing or transmission.
   (c)   When a contract is awarded pursuant to a reverse internet auction, the contract shall be awarded to lowest responsive and responsible bidder on each item in accordance with this chapter. The City of Stow may accept or reject any bid submitted by reverse internet auction, either in whole or in part.
   (d)   Nothing in this section shall be interpreted as to abrogate any existing requirement for formal or informal bidding as contained in this chapter. Reverse Internet Auctions contained herein shall be an alternative bidding procedure currently provided for in this chapter, and will be employed when deemed appropriate by the Director of Public Service.
   (e)   The Service Director is hereby authorized to enter into a service agreement or service agreements with Reverse Internet Auction providers without the necessity of further legislation or other action from Council, provided that such agreements are at no cost to the City of Stow.
