(a) There is established a Volunteer Firemen's Dependent Fund Board in and for the City.
(b) The Volunteer Firemen's Dependent Fund Board shall consist of five members as follows:
(1) Two members of Council;
(2) Two members elected by the volunteer firemen; and
(3) One elector of the City, elected by the Board members appointed in subsection (b)(1) and (2) hereof. This elector shall not be a public employee, a Council member or a Fire Department member.
(c) Vacancies occurring in the Board shall be filled as provided in Ohio R.C. 146.03
(d) The term of each Board member shall be one year. The first appointment shall continue to and through January 1, 1979. Thereafter each Board member shall serve a full term of one year.
(e) The legal advisor for the Volunteer Firemen's Dependent Fund Board shall be the City Law Director.
(f) The Finance Director is authorized to establish a Volunteer Firemen's Dependent Fund by rotary trust account. This trust account is assigned No. 40-27, and shall deposit into the Fund the sum of five hundred dollars ($500.00), the payment being made to the State Treasurer.
(g) The beneficiaries and benefits of the Volunteer Firemen's Dependent Fund shall be:
(1) The widow of a volunteer firemen killed in the discharge of his duties, in the amount of one thousand dollars ($1,000) plus one hundred dollars ($100.00) per month so long as she remains his widow.
(2) To the mutual guardian or other person upon whom a child of a volunteer firemen is dependent for child support, the sum of twenty-five dollars ($25.00) per month until that dependent child is sixteen years old, unless that child is regularly attending a recognized secondary school, in which case the payment shall continue until the child is eighteen years old or has completed secondary education, whichever is earlier; or
(3) To a volunteer fireman, duly and permanently disabled while in the discharge of his duties as a volunteer fireman, the sum of one hundred dollars ($100.00) per month, unless during that period as a volunteer fireman he may be under full salary during the term of his disability.
(h) The State Treasurer is designated as the custodian of the Volunteer Firemen's Dependent Fund and all disbursements and proceeds, to the extent that they are not otherwise in conflict herewith, shall be governed by the terms and provisions of Ohio R.C. Chapter 146.
