(a) The Department of Public Service, as established by Article VII of the City Charter, shall consist of:
(2) The Assistant Service Director, who shall be appointed by the Mayor and confirmed by Council who shall be in the unclassified service of the City, shall assist the Director of Public Service in the performance of his duties and shall perform such duties as may be assigned to him by the Director; and
(3) The Deputy Director of Public Service, who shall be appointed by the Mayor and confirmed by Council and who shall be in the unclassified service of the City, shall assist the Director of Public Service and the Assistant Service Director in the performance of their duties and shall perform such duties as may be assigned to him by the Director or the Assistant Service Director; and
(4) Those full-time or part-time employees as are deemed necessary by Council upon the recommendation of the Director.
(b) The Assistant Public Service Director shall become the Acting Director of Public Service with all of the powers and duties of the Director in the event that, and during such time as, the Director is unable for any cause or reason to perform the duties of his office. The determination that the Director is unable to perform the duties of this office shall be made by the Mayor. Following this determination, the subsequent determination that the Director is able to perform his duties, thereby relieving the Assistant Service Director of the powers and duties of the Director and returning the powers and duties to the Director, shall be made by the Mayor.
(c) The Deputy Director of Public Service shall become the Acting Director of Public Service with all of the powers and duties of the Director in the event that, and during such time as, the Director and Assistant Public Service Director is unable for any cause or reason to perform the duties of his office. The determination that the Director is unable to perform the duties of this office shall be made by the Mayor. Following this determination, the subsequent determination that the Director is able to perform his duties, thereby relieving the Assistant Service Director or the Deputy Director of Public Service of the powers and duties of the Director and returning the powers and duties to the Director, shall be made by the Mayor.
(d) The Director of Public Service shall, notwithstanding any other provisions of the Codified Ordinances in conflict herewith, be authorized to designate the Chief Building Official of the City, as the same may, from time to time, exist or be modified, subject to approval by the Board of Building Standards of the Department of Industrial Relations of the State in accordance with OBBC 4101:2-1-45(C), as the same may be from time to time amended.
