173.07 EXCEPTIONS TO BIDDING.
   (a)   Formal Competitive Bidding.
      (1)   When this Code or the City of Stow Charter provides for formal competitive bidding, such procedure may be bypassed and replaced with informal competitive bidding or RFP in the case of:
         A.   A real and present emergency;
         B.   Professional or personal services pursuant to the criteria of Section 173.09;
         C.   Petroleum/Utility purchases;
         D.   Insurance purchase;
         E.   Inter-Governmental purchases or contracts;
            1.   Purchase of used equipment from inter-governmental entity.
         F.   State or other governmental bidding purchases as defined by the Code;
         G.   Sole source provider;
         H.   Contract Renewals.

   (b)   Informal Competitive Bidding and Request for Proposal.
      (1)   When this Code provides for informal competitive bidding or RFP, said procedure may be bypassed in the case of:
         A.   Sole source provider;
         B.   A real and present emergency;
         C.   State or other governmental bidding purchases as defined by this Code.
         D.   Preferred source provider.
         E.   Best practical source provider.
         F.   Contract renewals when legislative approval is obtained from City Council. Renewals shall be limited to two consecutive twelve month periods following the designated termination date of the original contract. At the time a request for renewal is made Council shall be advised of any price changes and/or any significant modifications to the original contract. The request shall be made within a timely fashion, in order to allow for the possibility of having to obtain RFP’s or other bids. In order to allow for the possibility that this exception would not be approved, the renewal request must be presented to Council at least two Council meetings prior to the termination date of the current contact or alternatively in sufficient advance time to allow for RFP’s or bidding.
         G.   Professional/Personal Services contracts in special circumstances that can be clearly demonstrated to City Council as being in the best interests of the City. Legislative approval shall be required and the firm or individual selected shall meet the criteria as set forth under Section 173.09, Criteria for Selecting Professional Services.

   (c)   Contracts awarded as an exception to competitive bidding pursuant to this section shall be noted in the minutes of the Board of Control and the basis shall be reflected in the minutes.
