(a) Council hereby declares that K-1 Kerosene shall only be dispensed into metal containers clearly demarked and labeled, in conspicuous form, across the front of such container, the word KEROSENE, to insure that no consumer shall inadvertently cause K-1 Kerosene to be dispensed into an improper container or a container which would otherwise have residual amounts of gasoline or other flammable liquids known or unknown to the consumer. The word "Kerosene" shall be in three-inch letters if the container is five gallons or more. For any container under five gallons, the word "kerosene" shall be in two-inch letters. No kerosene shall be dispensed into red cans.
(b) Any dispenser of K-1 Kerosene found to be dispensing kerosene into an improper container shall be guilty of a misdemeanor of the fourth degree and subject to such statutory fines as shall be set forth in the Ohio Revised Code for such an offense. Further, any consumer who obtains K-1 Kerosene in the City in an unauthorized container, except as set forth herein, shall be guilty of a misdemeanor of the fourth degree and subject to such statutory fines as shall be set forth in the Ohio Revised Code for such an offense.
