955.04 GROUPS CHARGED NOMINAL FEES FOR THE RENTAL OF STOW HERITAGE BARN AND SILVER SPRINGS LODGE.
      (a)   Rental of Stow Heritage Barn and Silver Springs Lodge:
      (1)   For all meetings, public service or community events sponsored by a Stow City oriented community nonprofit organization, a nominal rental fee of seventy-five dollars ($75.00) will be charged to offset maintenance costs at the facility.
      (2)   For all fundraisers and charitable benefits sponsored by a Stow City oriented community nonprofit organization, a nominal rental fee of one hundred dollars ($100.00) will be charged.
      (3)   Governmental units, such as the Summit County Board of Elections, are exempt from a flat fee, but will be required to pay a maintenance fee to offset maintenance costs at the facilities.
   (b)   Any Stow city oriented group which qualifies shall be eligible to pay a nominal fee upon making application therefor to the Director of Parks and Recreation.
   (c)   The Director of Parks and Recreation (“Director”) shall keep an official list and record of Stow City oriented community nonprofit organizations who are eligible to pay a nominal fee for these facilities. In the event the Director determines that a Stow City oriented community nonprofit organization is eligible to pay a nominal fee, the Director shall cause the name thereof to be affixed to the Director’s record. However, should the Director determine that a group does not so qualify, the Director shall submit the finding in writing with the reasons therefor to any authorized representative of the group. Any non-qualifying group may appeal the Director’s decision to the Public Improvements Committee of Council and to Council itself.
   (d)   The Director of Parks and Recreation, via this section, shall have the authority to waive rental fees for the use of any picnic shelters up to a maximum amount not to exceed fifty dollars ($50.00) for any of the herein listed groups or organizations.
   (f)   Security Deposit.
      (1)   Any Stow City oriented community nonprofit organizations who are eligible to pay a nominal fee for these facilities who shall be required to submit a security deposit in the following amounts:
         A.   With alcoholic beverages   $200.00
         B.   Without alcoholic beverages   25.00
      (2)   Monies will be deducted from the security deposit for:
         A.   Facility damage;
         B.   Stays beyond the original term; and
         C.   Deviation of use of the facility from the use as stated in the application.
