Any act constituting a violation of this chapter or failure to comply with any of its requirements shall subject the offender to a civil penalty of $100 for the first offense, $200 for the second offense and revocation of permit for a period of two years for the third offense. If the offender fails to pay the penalty within ten days of receiving notice of the violation, the penalty may be recovered by the town in a civil action in the nature of the debt, and the offender shall be responsible for any court costs and attorneys’ fees incurred by the town. In addition to the foregoing, if any person shall violate this chapter, he or she shall be guilty of a Class 3 misdemeanor.
