(A) The Public Works Director shall establish collection routes and schedules and may alter these routes and schedules from time to time. A copy of the current routes and schedules shall be kept on file in the office of the Town Clerk. Notice of any changes in the routes or schedules shall be published in the local newspaper at least ten days before the changes are to become effective.
(B) (1) Whenever this chapter authorizes the Public Works Director to make a discretionary determination, all persons affected by that determination shall comply with it within 15 calendar days after receiving written notice of the determination and the reasons for it. Thereafter, a failure on the part of any person receiving such notice to comply with the determination shall constitute a violation of this chapter.
(2) The Public Works Director or his or her designee shall make a discretionary determination of persons in violation of § 50.37 of this chapter. The following actions will be taken against violators:
(a) Initial written notice shall be provided via certified mail by the Public Works Director or his or her designee to the property owner, occupier or the person(s) responsible for the property that he or she is in violation of § 50.37 of this chapter and that the debris must be removed within two weeks of the initial written warning.
(b) In the event that the property owner, occupier or other person(s) responsible for the property fails to comply with § 50.37 of this chapter after the initial written notice, a second notice shall be mailed by certified mail to the property owner, occupier or the person(s) responsible for the property that a $5 fine shall be placed on the next water/sewer bill. The fine shall occur repeatedly biweekly until the debris is removed by the property owner, occupier or the person(s) responsible for the property. The date of the initial $5 fine shall be stated in the certified letter.
(C) No person may damage, displace or otherwise interfere with solid waste receptacles or solid wastes stored or prepared for collection, except with the consent of the owner, lessee or occupant of the premises where those receptacles or solid wastes are located.
