§ 132.02 CURFEW.
   (A)   School curfew; unlawful activities. It shall be unlawful for any juvenile, between the age of seven and 16 years, who is subject to compulsory school attendance pursuant to the Illinois School Code, whether attending a public, private or parochial school, who has been expelled or suspended from attending the school, and who is not otherwise subject to the truancy laws established by the Illinois School Code, to be upon any public road, street, alley, park or other lands used for public purposes or in any public place of business or amusement within the village, during the following hours when the schools are in session:
      (1)   Sunday, Monday, Tuesday, Wednesday and Thursday: between 10:30 p.m. and 6:00 a.m. on the following day;
      (2)   Friday: between 11:00 p.m. and 6:00 a.m. on the following day; and
      (3)   Saturday: between 11:00 p.m. and 6:00 a.m. on the following day.
   (B)   Exceptions.
      (1)   Those accompanied by a parent or other person over 18 years of age having legal custody of the juvenile;
      (2)   Those engaged in, going to or coming from a place of employment, which employment is allowed under the laws of the state;
      (3)   Those seeking medical care or treatment;
      (4)   Those attending religious activities;
      (5)   Those engaged in interstate travel; and/or
      (6)   Those involved in an emergency situation.
   (C)   Enforcement. Upon observing, during daytime school hours, a juvenile between the age of seven and 16 years upon any public street, road, alley, park or in a public place of business or amusement, a police officer shall determine if the juvenile is a truant under the terms of the Illinois School Code. If not, the police officer shall determine the age of the juvenile and inquire into the reasons for his or her appearance in the public place. If it appears that the juvenile does not fall within the enumerated exceptions set forth in division (B) above, the juvenile shall be in violation of this section.
