(A) Devotion to duty. The Village President shall be the executive officer of the village and shall devote his or her full time to the duties of the office as a faithful and efficient discharge thereof may required. The President shall perform all duties prescribed by law, including the village ordinances, and shall take care that the laws and ordinances are faithfully executed.
(B) Appointments. The President, by and with the advice and consent of the Board of Trustees, shall appoint all officers of the village whose appointments are not otherwise provided for by law and whenever a vacancy shall occur in any office which, by statute or ordinance, the President is authorized to fill, the President shall, at a regular meeting of the Board, communicate to the Board the name of an appointee to the office and, pending the concurrence of the Board in the appointment, may designate some suitable person to discharge the duties of the office.
(C) Removal of officers for cause. Except where otherwise provided by statute, the President may remove any officer appointed by him or her on any formal charges whenever the President is of the opinion that the interests of the village demand removal. The President shall report the reasons for the removal to the Board at a meeting held not less than five, nor more than ten, days after the removal. If the President fails or refuses to report to the Board of Trustees the reasons for the removal or if the Board, by a two-thirds vote of all of its members authorized by law to be elected, disapproves of the removal, the officer, thereupon shall be restored to the office from which removal occurred. The vote shall be by yeas and nays and shall be entered in the minutes. In the event of restoration, the officer shall give a new bond and take a new oath of office. No officer shall be removed a second time for the same offense.
(D) Approval and veto of ordinances. The President shall carefully inspect all ordinances passed by the Board and fix his or her official signature to such as he or she may approve, and return them to the Village Clerk. Such ordinances as the President shall not approve shall be returned to the Board, with the President’s objections thereto in writing, at the next regular meeting of the Board, occurring not less than five days after the passage thereof. The veto may extend to any one or more items or appropriations contained in any ordinance making appropriations or to the entire ordinance. In case the veto only extends to a part of the ordinance, the rest thereof shall take effect and be in force. In case the President shall fail to return any ordinance with his or her objections thereto by the time aforesaid, the President shall be deemed to have approved the ordinance and it shall take effect accordingly.
(E) Resolutions and motions; approved, veto. All resolutions or motions:
(1) Which create any liability against the village;
(2) Which provide for the expenditure or appropriation of the village’s money; or
(3) To sell any village property passed by the Board of Trustees shall be deposited with the Village Clerk. If the President approves them, he or she shall sign them. Those of which the President disapproves shall be returned to the Board, with the President’s objections thereto in writing, at the next regular meeting of the Board, occurring not less than five days after the passage thereof. The veto may extend to any one or more items or appropriations contained in any resolutions and motion, the rest thereof shall take effect and be in force. In case the President shall fail to return any resolution and motion with his or her objections thereto by the time aforesaid, the President shall be deemed to have approved the resolution and motion and it shall take effect accordingly.
(F) Sign commissions. The President shall issue certificates of appointments to all persons appointed to office. The certificates shall be issued under the corporate seal or the Village Clerk. The Village Clerk shall sign the certificates also.
(G) Sign warrants. The President shall sign all warrants drawn upon the Village Treasurer. The warrant shall state the particular fund and the appropriation to which the warrant shall be chargeable and the person to whom payable. The Village Clerk and Village Treasurer shall countersign the warrant.
(H) Sign licenses. The President shall sign all licenses and permits granted, issued or ordered by the Board or authorized by ordinance and may revoke any license or permit for causes provided by statute or ordinance.
(I) Examine records. The President may, at any time, examine and inspect the books, records and papers of any agent, employee or officer of the village.
(J) Recommendations to the Board. Annually, the President shall give the Board of Trustees information relative to the affairs of the village. From time to time, the President may recommend for Board consideration the measures he or she believes expedient.
(K) Administration of oaths. The President shall have power to administer oaths and affirmations upon all lawful occasions.
(L) Call for special election. In the event there is a vacancy in an elective office and if, for any reason, there is not a quorum in office of the corporate authorities, the President may call for a special election to fill the vacancy and, at the time of calling the special election, the President shall appoint the time and place, give notice thereof and appoint the judges of the election.
(M) Execute leases. The President shall have the power to execute, on behalf of the village, all leases entered into by the corporate authorities.
(N) Rebate taxes. The President shall have the power, together with the Village Clerk, to execute, on behalf of the village, all deeds of conveyance of real estate to those parties purchasing the real estate after the purchase price has been paid or secured; provided, the deed of conveyance shall state the purchase price of the property and be under the corporate seal.
(O) Liquor Control Commissioner. The Village President shall be the Liquor Control Commissioner of the village and perform those duties stated in the Liquor Control Ordinance, set out in Ch. 111 of this code of ordinances.
