(A) Each ice cream vendor must obtain an annual operating permit from the Village Clerk's office for each ice cream push cart it seeks to operate within the village at the following cost:
Fifty dollars for each ice cream push cart.
(B) Each ice cream vendor must supply the village with a phone number which the Village Police Department may utilize to contact and locate each ice cream push cart operating in the village. If this phone number is not a direct phone number to the ice cream push cart, the person answering this phone must have the ability to immediately contact the operator of the ice cream push cart.
(C) Prior to obtaining a permit, the village will require proof that the ice cream push cart is in compliance with all provisions of this section, including but not limited to, proof of insurance and verification that all employees have received background checks. In addition, all ice cream vendors must be in compliance at all times with all applicable federal, state and village laws and regulations.
(D) The village will limit the issuance of permits to a maximum of three companies and each company will be limited to no more than one ice cream push cart. Applications for permits will be processed in the order in which they are received.
(E) (1) All permit applicants will be required to provide an original certificate of insurance evidencing the following insurance minimums:
(a) Workers compensation and employers liability: Minimum of $500,000 each accident, illness or disease;
(b) Commercial general liability: Minimum of $1,000,000 per occurrence.
(2) All insurance policies required under this section shall name the village as an additional insured. Cancellation of any insurance policy required under this section shall result in automatic revocation of an issued annual operating permit.
(F) A current, valid village operating permit issued to that individual ice cream push cart must be visibly displayed on the front panel of the ice cream push cart.
