For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CHARITABLE NOT FOR-PROFIT. Patriotic, philanthropic, religious, social service, welfare, benevolent, educational, civic or factional, either actual or purported.
PROFESSIONAL PROMOTER. A person who, for compensation, plans, promotes, conducts, manages or carries on or attempts to plan, promote, conduct, manage or carry on any drive or campaign for the purpose of soliciting contributions for or on behalf of any charitable not-for-profit person; a person who engages in the business of soliciting contributions for a charitable not-for-profit purpose. A bona fide officer or regular employee of a charitable not-for-profit person shall not be deemed a PROFESSIONAL PROMOTER by reason of his or her participation in a charitable-not-for-profit solicitation may be or on behalf of his or her employer.
PROFESSIONAL SOLICITOR. A person other than a professional promoter who is employed or retained for compensation to make solicitations in connection with a charitable not-for-profit solicitation. A bona fide officer or regular employee of a charitable not-for-profit person shall not be deemed a PROFESSIONAL SOLICITOR by reason of his or her participation in charitable not-for-profit solicitations made by or on behalf of his or her employer.
SOLICIT; SOLICITATIONS. The request, directly or indirectly, for money or financial assistance on the plea or representation that the money or financial assistance will be used for a charitable not-for-profit purpose within the above definition of “charitable not-for-profit”.
