(A) No person shall be eligible to hold any office, other than that of Village Attorney, Village Engineer, Director of Public Safety and Director of Public Works, under the village government who is not a qualified elector of the village and who shall not have resided therein for at least one year preceding his or her election or appointment; nor shall any person be eligible to any office who is a defaulter to the village.
(B) In the case of the appointment of a Director of Public Safety and Director of Public Works who is not a resident of the village at the time of his or her appointment, the Director of Public Safety and Director of Public Works shall be required to reside within the boundaries of Higgins Road on the north, Harlem Avenue on the east, Route 53 on the west and Roosevelt Road on the south of the corporate limits of the village within six months of his or her appointment.
(C) Except as described in divisions (A) and (B) above, all employees, heads of departments and commission members are required to reside in the village at the time of being hired or appointed or within one year of being appointed. All employees, heads of departments and commission members are required to establish residency in the village.
(D) All employees, heads of departments and commission members are required to maintain residency in the village during their term of service to the village.
(E) The provisions of this section do not apply to Police Department personnel and to legal, medical and engineering professions’ appointments.
(F) Non-resident village employees currently holding positions with the village are not bound by the provisions of this section.
(G) In the event a position of employment with the village demands it be filled by a certified, qualified person who has the necessary credentials and expertise to be hired and appointed to that position and the Village Board cannot fill that position with a resident or would-be resident, the Board may waive the residency requirement to fill that position.
(H) Any village employee, head of a department and/or commission member failing to comply with the provisions of divisions (C) and (D) above will forfeit his or her position at the time of non-compliance.
