§ 93.19 PERMITTED DESIGNATED SMOKING AREAS.
   (A)   The owner or other person in control of the enclosed public place or place of employment within the village who has designated a portion thereof for smoking must clearly display signage, in form and content approved by the village, indicating the portion of the enclosed public place and/or place of employment where smoking is permitted.
   (B)   The owner or other person having control of an area where smoking is prohibited by this subchapter shall remove all ashtrays and other smoking paraphernalia intended for use where smoking is prohibited.
   (C)   The designated smoking areas established herein must minimize the intrusion of smoke into areas where smoking is not permitted by meeting the following requirements.
      (1)   The designated smoking area must have an air purification device and/or ventilation system installed to mitigate and/or eliminate the re-circulation of the environmental smoke generated.
      (2)   The air purification device(s) and/or ventilation system(s) must be maintained in proper working order.
      (3)   The number of smokers permitted in the designated smoking area shall not exceed the capacity of the air purification device(s) and/or ventilation system(s) to mitigate or eliminate environmental smoke.
   (D)   When a public place or place of employment is a single room or enclosure, an owner or other person in control of the public place and/or place of employment establishing such an area may satisfy the purpose or provisions of this section by establishing a reasonable portion of the room or enclosure as a smoking area.
