ORDINANCE NO. 19-15

AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE VILLAGE OF STONE PARK

WHEREAS, the Village of Stone Park (hereinafter referred to as the "Village") is an Illinois Municipal Corporation organized pursuant to the laws of the State of Illinois;

WHEREAS, the Village of Stone Park is a home rule unit of local government with authority granted pursuant to the Illinois Constitution of 1970, to exercise certain powers and perform certain functions pertaining to its local government and affairs;

WHEREAS, the Village has adopted and codified the Village of Stone Park Code of Ordinances (hereinafter referred to as the "Village Code"), as amended;

WHEREAS, American Legal Publishing Corporation of Cincinnati, Ohio, (hereinafter referred to as the "Codifier") has completed the 2019 supplement to the Code of Ordinances of the Village of Stone Park, County of Cook, State of Illinois,

WHEREAS, said supplement contains all ordinances of a general and permanent nature enacted since the prior supplement to the Code of Ordinances of the Village of Stone Park;

WHEREAS, the Codifier has recommended the revision or addition of certain sections of the Code of Ordinances which are based on or make reference to sections of the State of Illinois Compiled Statutes;

WHEREAS, it is the intent of the Village of Stone Park Board of Trustees to accept these updated sections in accordance with the changes of the laws of the State of Illinois; and

WHEREAS, it is necessary to provide for the usual daily operation of the Village of Stone Park and for the immediate preservation of the public peace, health, safety and general welfare of the Village of Stone Park that this ordinance take immediate effect upon its passage and approval as required by law.

NOW, THEREFORE, BE IT ORDAINED by the Village President and Board of Trustees of the Village of Stone Park, Cook County, Illinois, pursuant to the Village of Stone Park's "Home Rule" power, as follows:

Section One - Recitals

The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this ordinance as legislative findings.

Section Two - Enactment

   a)   That the 2019 supplement to the Code of Ordinances of the Village of Stone Park as submitted by the Codifier, and as attached hereto and made a part hereof as Exhibit A, and is hereby adopted by reference as if set out in its entirety.

   b)   All prior ordinances pertaining to the subjects treated in such Code of Ordinances shall be deemed repealed from and after the effective date of this ordinance except as they are included and reordained in whole or in part in such Code; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing the purchase or sales of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code.

   c)   Such Code shall be in full force and effect as provided herein, and such code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage and that the same is properly signed, attested, recorded and approved and that any public hearings and notices thereof as required by law have been given,

   d)   Such supplement shall be deemed published as of the day of its adoption and approval by the Village of Stone Park and the Village Clerk is hereby authorized and ordered to insert such supplement into the copy of the Code of Ordinances of the Village of Stone Park a copy of which is kept in the Office of the Village Clerk.

Section Three - State of an Emergency

This ordinance is declared to be an emergency measure necessary for the immediate preservation of the peace, health, safety and general welfare of the people of the Village of Stone Park.

Section Four - Effective Date

This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.

Section Five - Recording

This ordinance shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Stone Park.
