(A) Any live entertainment including but not limited to bands shall not be permitted in residential areas without a permit. Casa Italia is exempt as it is not zoned R-1 and is a multi-use facility.
(B) The village may issue a permit for live entertainment upon completion of an application and payment of the permit fee.
(C) Contents of application.
(1) Name and address of applicant;
(2) Date and time of live entertainment;
(3) Description of live entertainment; and
(4) Any other necessary and reasonable information the village may require.
(D) Restriction and regulations for permit.
(1) Live entertainment shall only be permitted for a maximum of two consecutive hours on the approved date.
(2) Permits for live entertainment shall only be issued for the following days and times:
(a) Fridays from 6:00 p.m. to 9:00 p.m.;
(b) Saturdays from 12:00 p.m. to 9:00 p.m.;
(c) Sundays from 12:00 p.m. to 8:00 p.m.; and
(d) Designated holidays from 12:00 p.m. to 8:00 p.m.
(3) Applicant must obtain the unanimous approval of all neighbors within a 300 foot radius of the applicant’s property line, applicant shall submit a petition evidencing same.
(4) No applicant and/or residence shall receive more than two permits for live entertainment in any calendar year.
(5) Applicants that receive two or more citations in any 12 month period shall be ineligible to receive a permit for live music for a period of 12 months from the date of the last violation.
(E) The penalty for a violation of this section shall be as follows:
(1) One hundred dollars for the first offense;
(2) Two hundred and fifty dollars for the second offense; and
(3) Five hundred dollars for all subsequent offenses.
