3-3-13: PREMISES REQUIREMENTS AND RESTRICTIONS:
   A.   Sanitary Conditions: All premises used for the sale of alcoholic liquor, or for the storage of such liquor for sale, shall be kept in a clean and sanitary condition, in full compliance with State statutes and County and Village ordinances regulating the condition of premises used for the storage or sale of food or alcoholic liquor for human consumption 1 .
   B.   Access From Licensed Premises To Dwelling Quarters: Except in the cases of hotels and clubs, no alcoholic liquor shall be sold at retail upon any premises which has any access which leads from such premises to any other portion of the same building or structure used for dwelling or lodging purposes and which is permitted to be used or kept accessible for any use by the public. This provision shall not prevent any connection between such premises and such other portion of the building or structure which is used only by the licensee, his family and personal guests.
   C.   View From Street: In premises in which the sale of alcoholic liquor for consumption on the premises is licensed, other than in restaurants, hotels or clubs, or any bowling alley other than one situated on the first or ground floor, no screen, blind, curtain, partition, article or thing shall be permitted in the windows or upon the doors of such licensed premises nor inside such premises, which shall prevent a clear view into the interior of such licensed premises from the street, road or sidewalk at all times. No booth, screen, partition or other obstruction nor any arrangement of lights or lighting shall be permitted in or about the interior of such premises which shall prevent a full view of the entire interior of such premises, and the entire space used by the public must be so located that there shall be a full view of the same from the street, road or sidewalk. All rooms where alcoholic liquor is sold for consumption on the premises shall be continually lighted during business hours by natural or artificial white lights so that all parts of the interior of the premises shall be clearly visible. In case the view into any such licensed premises required by the foregoing provisions shall be wilfully obscured or obstructed by the licensee, such license may be revoked in the manner herein provided. In order to enforce the provisions of this subsection, the Local Liquor Control Commissioner shall have the right to require the filing of plans, drawings and photographs showing the clearance of the view as above required.
   D.   Prohibited Types Of Entertainment: It is unlawful for any licensee to:
      1.   Provide any service or performance to patrons, by means of live entertainment, video, or film, or by any other means, in such a manner as to expose to public view, with less than fully opaque covering:
         a.   Part or all of male or female genitals, pubic hair, buttocks, perineum, anal region or pubic region;
         b.   Any device, costume or covering which gives the appearance of or simulates part or all of the male or female genitals, pubic hair, buttocks, perineum, anal region or pubic hair region;
         c.   Any portion of the female breast at or below the areola thereof.
      2.   Provide any service or performance to patrons, by means of live entertainment, video or film, or by any other means, in such a manner as to expose to public view:
         a.   The performance of acts of sexual intercourse, masturbation, or deviate sexual conduct;
         b.   The actual or simulated touching, caressing, or fondling of the genitals, buttocks, or female breast.
      3.   Promote the commission of any of the above listed unlawful acts whether or not said acts take place on the licensed premises.
A violation of this subsection will constitute an unlawful act subjecting the offender to the penalties of not less than five hundred dollars ($500.00), nor more than one thousand dollars ($1,000.00) and/or suspension or revocation of license as provided herein. (Ord. 300, 11-21-1989)
