3-3-8: LICENSE CLASSIFICATION AND FEES:
   A.   Class A:
      1.   The class A-1 license shall authorize the sale of alcoholic liquor on the specified premises to the general public for both on premises or off premises consumption.
      2.   The class A-2 license shall authorize the sale of alcoholic liquor on the specified premises to the general public for off premises consumption only.
The annual fee for such license shall be one thousand dollars ($1,000.00). (Ord. 300, 11-21-1989)
   B.   Class B:
      1.   The Class B license shall be known as a one day liquor license.
Applicants shall be legally recognized religious, charitable or not for profit organizations or a recognized organization organized for nonpecuniary purposes acceptable to the Liquor Commissioner. Applicants are subject to the same review and investigation as provided in this chapter of any other applicant or licensee.
Such licenses shall be issued in connection with a fair, carnival, bazaar, street dance, picnic, reception, outdoor outing or such other fundraising or similar special event open to the public which shall be the principal reason for the gathering or activity and the consumption of alcoholic beverages being incidental thereto. All alcoholic beverage consumption authorized by the license hereunder shall be consumed within the limits of a designated enclosed or fenced area, owned or utilized by the applicant/licensee, and as clearly set forth in the license application so that the Liquor Commissioner, general public and law enforcement officers can easily determine the limits of such area.
All alcoholic beverages shall be dispensed in returnable or disposable bottles, cups or cans and adequate containers shall be provided for disposal or recycling of same.
The Liquor Commissioner, Chief of Police or other law enforcement officer may order the sale, dispensing and consumption of alcoholic beverages at any special event halted if, in his or her judgment, any of the provisions of this chapter are being violated or the public peace is likely to be endangered.
      2.   A Class B licensee may lawfully sell alcoholic beverages from six o'clock (6:00) A.M. on the date of its license to one o'clock (1:00) A.M. on the following day. (Ord. 608, 6-9-2015)
      3.   The Class B license shall be issued upon approval of the Local Liquor Control Commissioner. (Ord. 669, 6-11-2019)
      4.   The license fee for a Class B license shall be twenty five dollars ($25.00). At the time of application, the prospective Class B licensee shall provide evidence of "dramshop" liability insurance for both the licensee and/or the owner of the premises where the alcoholic beverages are to be sold/consumed.
      5.   All regulations that are part of this chapter shall apply in the same manner and degree as they apply to all other classes of license described herein.
      6.   No more than one such license shall be issued for a specific date or particular time period unless in the judgment of the Liquor Commissioner issuing multiple licenses for a given event will prove to be in the best interests of the Municipality. Applicants for this license may obtain no more than four (4) such licenses in any calendar year. (Ord. 608, 6-9-2015)
   C.   Class C:
      1.   The Class C, one day, license shall authorize the sale and consumption of alcoholic liquor on the licensee's premises a day at a time.
      2.   An applicant shall be the owner of a business, or principal shareholder of an incorporated business, that has been operating and actively doing business within the Village for at least a one year period prior to such application being made.
      3.   The annual application fee for a Class C, one day, license shall be twenty five dollars ($25.00). The fee for each day's use of such license shall be fifty dollars ($50.00). For a one day use only during a calendar year, the application fee shall be waived.
      4.   a. The Class C, one day, license shall be issued only by approval of the Board of Trustees at a regularly scheduled meeting.
         b.   At least twenty four (24) hours prior to each use of such license, the licensee shall notify the Village Clerk during regular Village Hall office hours of such planned use and pay the fee specified above.
      5.   At the time of application, the prospective Class C licensee shall provide evidence of liability insurance(s), including "dramshop" coverage, for both the prospective licensee and the owner of the premises where the alcoholic liquor is to be sold and consumed.
      6.   All regulations that are part of this chapter shall apply in the same manner and degree as they apply to all other classes of licenses and licensees described herein. (Ord. 316, 9-3-1991)
