8-13-8-4: MONITORING FACILITY DEVICE MALFUNCTION:
The Village and user shall attempt to resolve any disputes regarding monitoring facility device inaccuracies in accordance with the guidelines prescribed below:
   A.   If a monitoring device malfunctions or is demonstrated to have provided incorrect readings, or if an identifiable consistent sampling bias or error can be established, the volume and strength of wastewater discharged by a user shall be based on historical data and reasonable engineering estimates of flow and strength. This extrapolation, as determined by the Village with consultation with the user, shall take into account all materially known product variations.
   B.   The Village may install or require the user to install a temporary monitoring device until a permanent monitoring device is operating properly. The data generated by the temporary monitoring device shall be used in lieu of historical data.
   C.   Retroactive billing adjustments made as a result of monitoring device malfunction shall follow the terms of a user's individual wastewater discharge permit or other agreement between the Village and said user. (Ord. 701, 12-8-2020)
