8-13-8-1: RIGHT OF ENTRY: INSPECTION AND SAMPLING:
   A.   The public works coordinator and other duly authorized employees of the Village, the IEPA, and USEPA, bearing proper credentials and identification, shall be authorized to enter all properties to verify compliance with this chapter, any individual wastewater discharge permit, and other chapters of this code related to the Village POTW and sanitary sewer system. Users shall allow the Village ready access to all parts of the premises for the purpose of inspection, sampling, records examination and copying, and the performance of any additional duties. Any representatives of the Village shall have no authority to inquire into any processes, including metallurgical, chemical, oil refining, ceramic, paper or other industries beyond that point having a direct bearing on the kind and source of discharge to the sewers or waterway or facilities for waste treatment.
   B.   While performing the necessary work on private properties referred to in subsection A of this section, the public works coordinator or duly authorized representative of the Village, the Illinois Environmental Protection Agency and the U.S. Environmental Protection Agency shall observe all safety rules applicable to the premises established by the user and the user shall be held harmless for the injury or death to the Village employees and the Village shall indemnify the User against liability claims and demands for personal injury or property damage asserted against the user and growing out of the gauging and sampling operation, except as such may be caused by the negligence for failure of the user to maintain monitoring facilities as required in this chapter.
   C.   Where a user has security measures in force which require proper identification and clearance before entry into its premises, the user shall make necessary arrangements with its security guards so that, upon presentation of suitable identification, Village representatives shall be authorized to enter without delay for the purposes of performing specific responsibilities.
   D.   The Village shall have the right to set up on the user's property, or require installation of, such devices as are necessary to conduct sampling and/or metering of the user's operations.
   E.   The Village may require the user to install monitoring equipment as necessary and at the expense of the user. The facility's sampling and flow monitoring equipment shall be maintained at all times in a safe and proper operating condition by the user at its own expense.
   F.   The user and Village shall have access to the facility's sampling and flow monitoring equipment and may perform any inspections deemed necessary or desirable.
   G.   Any temporary or permanent obstruction to safe and easy access to the facility to be inspected and/or sampled shall be promptly removed by the user at the written or verbal request of the Village and shall not be replaced. The user is responsible for the cost of clearing obstructions.
   H.   Unreasonable delays in allowing the Village access to the user's premises shall be a violation of this chapter. (Ord. 701, 12-8-2020)
